Terms and Conditions of Sale

Article 1 – Introduction

LinguArty provides language workshops, conversation tables, cultural events, training, educational content and digital products designed to support language learning in an interactive and immersive environment.

Article 2 – Scope

These Terms and Conditions apply to all services offered by LinguArty, including online workshops, conversation tables, in-person events, training, educational resources, digital products and future services.

Article 3 – Registration and orders

Registration becomes final once the required payment has been received and the booking has been confirmed by LinguArty.

Article 4 – Prices

The prices displayed are those in effect at the time of booking. LinguArty reserves the right to change its prices for future services.

Article 5 – Payment terms

Payment is made using the methods offered at the time of booking. Unless otherwise stated, full payment is required before access to the service.

Article 6 – Cancellation and refunds

The applicable terms are detailed in LinguArty’s Cancellation Policy and Refund and Dispute Resolution Policy.

Article 7 – Participation in activities

Participants agree to behave respectfully and not to disrupt the proper running of activities.

Article 8 – Online activities

Participants are responsible for their internet connection, equipment and access to the platforms used.

Article 9 – Intellectual property

Content provided by LinguArty is protected by intellectual property laws and may not be reproduced or distributed without written permission.

Article 10 – Data protection

Personal data is processed in accordance with LinguArty’s Privacy Policy and the GDPR.

Article 11 – Force majeure

LinguArty shall not be liable for failure to perform its obligations in the event of force majeure.

Article 12 – Limitation of liability

LinguArty provides educational and cultural services without guaranteeing a specific result.

Article 13 – Complaints

Any complaint must be submitted in writing using LinguArty’s official contact details.

Article 14 – Governing law

These Terms and Conditions are governed by Irish law. The competent courts of Ireland shall have exclusive jurisdiction, subject to any mandatory consumer protection provisions.

Article 15 – Changes to the Terms

LinguArty reserves the right to amend these Terms and Conditions at any time.

Cancellation Policy

Purpose

This Cancellation Policy defines the terms that apply when cancelling participation in activities offered by LinguArty, including online workshops, conversation tables, in-person events, training, cultural activities and any other service organised by LinguArty.

Cancellation by the participant

Any cancellation request must be submitted in writing to LinguArty’s official contact address. The date on which the cancellation request is received determines the applicable terms.

  • More than 7 days before the activity: the terms of the Refund Policy apply.
  • Between 2 and 7 days before the activity: the terms of the Refund Policy apply.
  • Less than 48 hours before the activity: no refund is guaranteed unless otherwise provided in the Refund Policy.
  • Failure to attend without notice (“no-show”): no refund or rescheduling.

Rescheduling requests

Where organisationally possible, LinguArty may offer to move the booking to another similar session. Rescheduling depends on available places, the type of activity, the timing of the request, and logistical and educational constraints.

Cancellation by LinguArty

LinguArty reserves the right to cancel, postpone or change an activity due to insufficient participant numbers, an instructor’s unavailability, a major technical issue, an event beyond its control or exceptional circumstances. Participants shall be informed as soon as possible.

Force majeure

Neither party shall be liable for a delay, change or cancellation caused by force majeure, including natural disasters, fire, pandemics, industrial disputes, major disruption to communication networks, government decisions or any other event reasonably beyond the parties’ control.

Applicable documents

This Cancellation Policy must be read together with LinguArty’s Terms and Conditions, Refund Policy and Privacy Policy. In the event of a conflict, the Refund Policy shall take precedence on refund-related matters.

Refund and Dispute Resolution Policy

1. Purpose

This policy defines the refund, cancellation and dispute resolution terms applicable to all services, events, training courses, workshops, cultural experiences, in-person or online activities, and digital products offered by LinguArty.

2. Bookings and payments

Bookings are confirmed only after the required payment has been received.

3. Cancellation by the participant

More than 14 days before the activity: full refund. Between 7 and 14 days: 50% refund. Less than 7 days: no refund. Rescheduling or credit may be offered at LinguArty’s discretion.

4. Cancellation or changes by LinguArty

In the event of force majeure, insufficient participant numbers or other exceptional circumstances, LinguArty may postpone, change or cancel an activity. The participant may choose between rescheduling, a credit valid for 12 months or a full refund.

5. Digital products

Digital products are non-refundable once they have been made available, except in the event of a confirmed technical fault.

6. Gift cards and credits

Gift cards and credits are non-refundable, cannot be exchanged for cash and are valid for 12 months unless otherwise stated.

7. Force majeure

LinguArty shall not be liable for events reasonably beyond its control.

8. Complaints

Any complaint must be submitted in writing within 30 days of the relevant event or service.

9. Limitation of liability

LinguArty’s liability is limited to the amount paid for the relevant service, to the extent permitted by law.

10. Dispute resolution

The parties shall first seek an amicable resolution before initiating legal proceedings.

11. Governing law

These terms are governed by the laws of the Republic of Ireland.

13. Activities, excursions and stays organised with third-party providers

LinguArty shall not be liable for the acts or omissions of third-party providers. Refunds relating to these services depend on the terms of the relevant provider.

14. Accommodation, transport and additional costs

Costs incurred with third parties remain the participant’s responsibility. LinguArty’s liability is limited to amounts paid directly to LinguArty.

15. Participant responsibility

LinguArty may exclude without refund any person whose behaviour compromises safety or the proper running of an activity.

16. Insurance

Participants are encouraged to obtain insurance appropriate to their circumstances.

17. Health and safety

Participants are responsible for ensuring that their health allows them to take part in the chosen activity.

18. Photography, video and communications

Unless written objection is provided in advance, LinguArty may use photographs or videos taken during activities for communication and promotional purposes.
